These Terms & Conditions set out the rules for using the AKRI online store, placing orders, making payments, delivery, withdrawal from contracts and complaints.

Definitions

For the purposes of these Terms & Conditions:

  • Store means the online store operated at en.akri-global.eu.
  • Seller means APK Digital – Pavlo Prysiazhniuk, NIP 8181737492, REGON 528820929.
  • Customer means any natural person, legal person or organisational entity purchasing products through the Store.
  • Consumer means a natural person entering into a transaction with the Seller for purposes which are not directly connected with that person’s business or professional activity.
  • Consumer-like Entrepreneur means a natural person conducting business activity who is granted specific consumer protections under applicable Polish law where the contract is directly connected with that person’s business but is not of a professional nature for that person.
  • Business Customer means a Customer purchasing in connection with professional or business activity who is not entitled to the consumer protections applicable to a given transaction.
  • Product means a product offered for sale through the Store.
  • Standard Product means a Product ordered in a configuration offered as a standard option in the Store, including one of the upholstery colours available for selection on the Product page.
  • Custom Product means a non-prefabricated Product manufactured or modified according to an individual specification agreed with the Customer outside the standard configuration offered in the Store.

General Rules

These Terms & Conditions govern purchases made through the AKRI online store available at en.akri-global.eu.

The Store sells professional beauty salon equipment, including professional pedicure footrests manufactured and assembled in Poland.

Orders may be placed through the Store 24 hours a day, subject to temporary technical interruptions necessary for maintenance or circumstances beyond the Seller’s control.

The Store does not require the Customer to create a user account in order to place an order.

To use the Store, the Customer needs an internet-connected device, a current web browser and, for order communication, access to an email address.

Before placing an order, the Customer should review the Product description, selected configuration, estimated dispatch date, total price, delivery information and these Terms & Conditions.

Placing an Order

The Customer places an order by selecting a Product, choosing the available Product options, including the upholstery colour where applicable, adding the Product to the cart and completing the checkout process.

Before confirming the order, the Customer is able to review the order details and correct entered information.

The Customer is responsible for providing complete and correct information necessary to process and deliver the order, including the delivery address, email address and telephone number.

By submitting an order, the Customer confirms that they have reviewed and accepted these Terms & Conditions.

A sales contract is concluded when the Seller confirms acceptance of the order using the email address provided by the Customer.

If the Seller cannot fulfil the order, the Customer will be informed without undue delay. Any payment received for an order that cannot be fulfilled will be refunded.

Requests to change the colour, configuration or other details of an order should be submitted as soon as possible. A requested change may no longer be possible once preparation or assembly has started.

Nothing in the preceding paragraph limits any statutory rights granted to Consumers under applicable law.

Prices & Payment

Prices displayed in the English AKRI Store are expressed in euros (EUR).

Prices include VAT where applicable. The final amount payable by the Customer is displayed before the order is submitted.

Payments are made online using the payment methods made available during checkout.

Depending on the Customer’s country, device and payment eligibility, available payment methods may include:

  • debit and credit cards,
  • Apple Pay,
  • Google Pay,
  • Klarna,
  • Link,
  • other payment methods made available by the payment provider at checkout.

Availability of a particular payment method is not guaranteed and may depend on the country, device, bank or payment provider.

If the Customer’s payment account is maintained in a currency other than EUR, the Customer’s bank or payment provider may perform currency conversion and may charge its own fees.

Unless individually agreed otherwise, the Seller begins processing the order after successful payment.

Product Preparation & Dispatch

IMPORTANT BEFORE ORDERING

Please check the estimated dispatch date displayed on the Product page before placing your order.

AKRI Products are available in a wide range of upholstery colours.

Because it is not practical to keep every possible model and colour combination already assembled in stock, Products are generally assembled after the Customer places an order.

The Product page shows the current estimated dispatch date.

The estimated dispatch date means the approximate date on which the completed order is expected to leave the Seller’s workshop in Poland. It is not the expected date of delivery to the Customer.

Courier transit time begins only after the parcel has been handed over to the carrier.

An estimated dispatch date is an estimate based on the current production workload and available components.

If circumstances arise that materially affect the estimated dispatch date, the Seller will inform the Customer using the contact details provided in the order.

Delivery

Orders are shipped from Poland using DPD.

Standard delivery is currently available to the following countries:

Standard DPD delivery to the countries made available for ordering through the Store is free of charge unless clearly indicated otherwise before the order is placed.

If a country cannot be selected during checkout, standard delivery to that country is currently unavailable through the Store.

Delivery time after dispatch depends on the destination country, local courier operations and circumstances outside the Seller’s control.

The Customer should ensure that the delivery information entered during checkout is correct and that the parcel can be received at the provided address.

Additional costs resulting from an incorrect delivery address provided by the Customer or an unjustified failure to collect a parcel may be charged to the Customer where permitted by applicable law.

Consumer Right of Withdrawal

Subject to the statutory exceptions described below, a Consumer purchasing a Standard Product through the Store has the right to withdraw from the distance contract within 14 days without giving a reason.

The withdrawal period generally begins on the day on which the Consumer, or a third party indicated by the Consumer other than the carrier, receives the Product.

STANDARD COLOUR SELECTION

Choosing one of the standard upholstery colours offered for a Product in the Store does not, by itself, remove the Consumer’s statutory right of withdrawal.

To exercise the right of withdrawal, the Consumer must inform the Seller of the decision to withdraw by an unequivocal statement before the withdrawal period expires.

The model withdrawal form included at the end of these Terms may be used, but its use is not mandatory.

Returning a Product After Withdrawal

A Product returned following withdrawal should be sent without undue delay and no later than 14 days from the date on which the Consumer informed the Seller about the withdrawal.

The Consumer bears the direct cost of returning a Standard Product following an ordinary withdrawal, unless the Seller has expressly agreed to bear that cost.

A Product should be appropriately protected and packaged for return transport.

The Consumer is responsible for any diminished value of the Product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product.

Refund

The Seller will refund payments due as a result of a valid withdrawal within the period required by applicable law.

The Seller may withhold reimbursement until the returned Product has been received or until the Consumer provides evidence that the Product has been sent back, whichever occurs first, where permitted by applicable law.

The refund will generally be made using the same payment method used for the original transaction unless another method is expressly agreed.

Custom & Individually Modified Products

The statutory right of withdrawal may not apply to non-prefabricated goods manufactured according to the Consumer’s individual specification or clearly intended to satisfy the Consumer’s individualised needs.

This may apply, for example, where the Seller individually agrees to manufacture or modify a Product outside the standard options offered in the Store, such as:

  • non-standard dimensions,
  • a non-standard construction,
  • individual structural modifications,
  • upholstery or material not included in the standard Store offer,
  • other individually agreed modifications made specifically for the Customer.

In such cases, where the statutory conditions are satisfied, the right of withdrawal is excluded pursuant to Article 38(1)(3) of the Polish Consumer Rights Act of 30 May 2014.

IMPORTANT

This exclusion concerns genuine individual specifications or modifications. It does not limit the Customer’s rights if the Product delivered is defective, damaged or otherwise not in conformity with the contract.

Complaints & Product Conformity

The ordinary right of withdrawal and a complaint concerning a Product that is not in conformity with the contract are separate legal matters.

The Seller is responsible to Consumers for the conformity of Products with the contract in accordance with applicable Polish consumer law.

A Product may be considered not in conformity with the contract in particular where:

  • the wrong Product was delivered,
  • the Product was delivered in a colour different from the ordered colour,
  • the delivered configuration differs from the confirmed order,
  • the Product has a defect,
  • the Product lacks required elements or functionality,
  • the Product was delivered damaged,
  • the Product otherwise fails to comply with the sales contract.

Under the statutory rules on conformity of goods, the Seller’s responsibility to a Consumer generally lasts for two years from delivery of the Product, unless a longer period applies.

Consumer Remedies

Where a Product is not in conformity with the contract, the Consumer may have statutory rights including repair or replacement.

In circumstances provided by law, the Consumer may also have the right to an appropriate price reduction or to withdraw from the contract because of the lack of conformity.

Statutory complaint rights are not limited by the rules concerning ordinary returns or by the exclusion relating to genuine individually manufactured Products.

How to Make a Complaint

Complaints may be submitted by email to:

The complaint should, where possible, include:

  • the Customer’s name,
  • order number,
  • description of the problem,
  • photographs where useful,
  • the Customer’s requested remedy.

Providing photographs may help the Seller assess the matter more quickly, but statutory rights are not conditional on providing photographs where the law does not require them.

The Seller will respond to a Consumer complaint within 14 days from the date of receipt where that statutory time limit applies.

Complaint Transport

Before sending a Product physically in connection with a complaint, the Customer should contact the Seller so that the appropriate transport procedure can be arranged.

Where the Consumer exercises statutory rights concerning a Product that is not in conformity with the contract, the costs required for repair or replacement, including necessary transport costs, are borne by the Seller as required by law.

Transport Damage

The Seller carefully prepares Products for transportation.

The Customer is encouraged to inspect the condition of the parcel at the time of delivery where reasonably possible.

If visible damage to the parcel or Product is noticed, the Customer should, where possible:

  • take photographs of the parcel before removing the packaging,
  • take photographs of the damaged Product,
  • retain the packaging,
  • notify the Seller as soon as reasonably possible.

These recommendations are intended to make the claim process easier. They do not remove or limit mandatory statutory Consumer rights.

Business Customers

The statutory Consumer right to withdraw from a distance contract does not automatically apply to purchases made by professional Business Customers.

Where an order is made directly for the professional purposes of a business, any cancellation or return that is not based on mandatory statutory rights requires the Seller’s prior agreement.

Certain provisions of Polish consumer law also apply to a natural person conducting business activity where a particular contract, despite being connected with that business, does not have a professional character for that person.

Whether such protection applies is assessed in accordance with applicable law and the circumstances of the particular transaction.

Personal Data & Cookies

Personal data provided in connection with use of the Store and performance of orders is processed in accordance with applicable data protection law.

Detailed information concerning the processing of personal data, cookies, analytics and third-party services is provided in the Store’s Privacy Policy .

The Store may use cookies and similar technologies necessary for operation of the website and, depending on the Customer’s choices, additional technologies for analytics or other permitted purposes.

Consumer Disputes

The Seller encourages Customers to contact AKRI directly first so that any problem can be reviewed and, where possible, resolved without formal proceedings.

A Consumer may have access to out-of-court consumer dispute resolution procedures provided under applicable law, including authorised consumer dispute resolution bodies.

Where a complaint does not resolve a Consumer dispute, the Seller will provide the information required by applicable Polish law concerning the relevant out-of-court dispute resolution procedure and whether the Seller agrees to participate in such proceedings.

Consumers involved in a cross-border dispute within the European Union may also seek assistance from the European Consumer Centre in their country.

Final Provisions

Matters not expressly regulated by these Terms & Conditions are governed by applicable Polish law, including the Polish Civil Code and the Polish Consumer Rights Act of 30 May 2014.

Where the Customer is a Consumer residing in another country, the choice of Polish law does not deprive that Consumer of mandatory protection granted by provisions of law that cannot be contractually excluded and would otherwise apply.

Any dispute will be submitted to the court having jurisdiction in accordance with applicable law.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.

The Seller may amend these Terms where justified, for example because of changes in law, payment methods, delivery arrangements or operation of the Store.

Amendments do not adversely change the terms applicable to sales contracts already concluded before the amendment takes effect.

These Terms & Conditions are available electronically on the Store website and may be saved or printed by the Customer.
